S.B. No. 644
AN ACT
relating to the eligibility of persons to participate in the public 
sale in certain counties of certain real property.
	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:                        
	SECTION 1.  Section 34.0445, Civil Practice and Remedies 
Code, is amended by adding Subsection (g) to read as follows:
	(g)  This section applies only to a sale of real property 
under this subchapter that is conducted in:
		(1)  a county with a population of 250,000 or more; or                 
		(2)  a county with a population of less than 250,000 in 
which the commissioners court by order has adopted the provisions 
of this section.
	SECTION 2.  Section 34.015, Tax Code, is amended by adding 
Subsection (p) to read as follows:
	(p)  This section applies only to a sale of real property 
under Section 34.01 that is conducted in:
		(1)  a county with a population of 250,000 or more; or                 
		(2)  a county with a population of less than 250,000 in 
which the commissioners court by order has adopted the provisions 
of this section.
	SECTION 3.  (a)  Section 34.0445, Civil Practice and 
Remedies Code, and Section 34.015, Tax Code, as amended by this Act, 
apply only to a public sale of real property conducted on or after 
the effective date of this Act.
	(b)  A public sale of real property conducted before the 
effective date of this Act is governed by the law in effect on the 
date the sale was conducted, and the former law is continued in 
effect for that purpose.
	SECTION 4.  This Act takes effect immediately if it receives 
a vote of two-thirds of all the members elected to each house, as 
provided by Section 39, Article III, Texas Constitution.  If this 
Act does not receive the vote necessary for immediate effect, this 
Act takes effect September 1, 2005.
