No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practice and Remedies Code to provide in the definition of acknowledgement in an acknowledgement form, that a member, manager, or authorized officer of a limited liability company personally appeared before the officer taking the acknowledgement and acknowledged executing the instrument as the act of the limited liability company.
The bill would provide a short form certificate of acknowledgement for a limited liability company.
Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
The bill would take effect September 1, 2019.
