BACKGROUND AND PURPOSE
It has been noted that there are several lottery games offered in Texas that have daily drawings, except that these drawings occur only on Monday through Saturday. While lottery tickets, including those for draw games, can be purchased seven days a week, the Texas Lottery Commission does not currently conduct drawings of the winning numbers on Sundays. H.B. 394 seeks to address this issue and increase state revenue and retailer commissions by requiring the lottery commission to adopt rules permitting Sunday drawings.

CRIMINAL JUSTICE IMPACT
It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY
It is the committee's opinion that rulemaking authority is expressly granted to the Texas Lottery Commission in SECTION 1 of this bill.

ANALYSIS
H.B. 394 amends the Government Code to require the Texas Lottery Commission, not later than January 1, 2022, to adopt rules permitting a lottery game drawing to be held on a Sunday.

EFFECTIVE DATE
On passage, or, if the bill does not receive the necessary vote, September 1, 2021.
