AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
Currently, the filing deadline for a petition for a place on the ballot for the Montgomery County Hospital District board of directors as set out in the district's enabling statutes is inconsistent with the deadline set out in the Election Code. This leaves open the possibility for a candidate to be disqualified from serving but still be elected if the candidate does not file a petition by both deadlines. H.B. 977 seeks to address this issue by aligning the applicable provision of the district's enabling statutes with the Election Code.
H.B. 977 amends current law relating to a petition filed for a place on the ballot for the board of directors for the Montgomery County Hospital District.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 1063.053, Special District Local Laws Code, as follows:
Sec. 1063.053. BALLOT PETITION. Requires that the petition for a place on the ballot as a candidate for director of the Montgomery County Hospital District be filed by the deadline imposed by Section 144.005 (Filing Deadline), Election Code, rather than requiring that the petition be filed at least 25 days before the date of the election.
SECTION 2. Effective date: September 1, 2021. �
