BACKGROUND AND PURPOSE

It has been noted that, while state law requires the Texas Workforce Commission (TWC) to provide biennial updates to the Apprenticeship Related Instruction Cost Study, the TWC has in practice replaced that report, whose last submission was made in 1975, with biannual reports to the Texas Workforce Investment Council and the Apprenticeship and Training Advisory Committee. H.B. 1799 seeks to update TWC reporting requirements in statute to reflect this change in practice and allow for compliance with statute without unnecessary duplication.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 1799 amends the Education Code to require the Texas Workforce Commission (TWC) at least annually to prepare and submit to the Texas Workforce Investment Council or to the Apprenticeship and Training Advisory Committee, as designated by the council, a report that includes the following:

· an apprenticeship-related instruction cost study for the most recent state fiscal year; and

· the funding distribution for apprenticeship-related instruction programs for the state fiscal year in which the report is submitted.

The bill removes the requirement for the TWC to prepare an update to the Apprenticeship Related Instruction Cost Study prior to each biennial legislative session.
