AUTHOR'S / SPONSOR'S STATEMENT OF INTENT
This bill resulted from a concern raised by the Dallas Police and Fire Pension System regarding the employees who administer the pension system.
Twenty-four (24) employees who manage that system do not have access to a defined benefit pension; the employees do not have access to the pension system they manage, nor do they have access to the City of Dallas municipal pension plan.
H.B. 4068 would enable the employees who manage the Dallas Police and Fire Pension System to become part of the Texas Municipal Retirement System.
H.B. 4068 amends current law relating to the eligibility of certain public retirement systems for police and fire fighters to participate in the Texas Municipal Retirement System.
RULEMAKING AUTHORITY
This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.
SECTION BY SECTION ANALYSIS
SECTION 1. Amends Section 852.005, Government Code, by amending Subsection (a) and adding Subsection (b), as follows:
(a) Provides that, for the purposes of Subtitle G (Texas Municipal Retirement System), the Texas Municipal Retirement System (TMRS), the pension system provided under Article 6243a-1, Revised Statutes, and the Texas Municipal League, have the standing of municipalities. Deletes existing text providing that Subsection (b) provides a limit on Subsection (a).
(b) Provides that the standing of the pension system provided under Article 6243a-1, Revised Statutes, as a municipality under Subsection (a) applies only with respect to the system and the system's employees. Provides that Subsection (a) does not require or authorize:
(1) a person who is a member, pensioner, alternate payee, or other beneficiary of the pension system provided under Article 6243a-1, Revised Statutes, to participate in TMRS; and
(2) the consolidation of both public retirement systems or the transfer of a fund or any plan created or maintained under former Article 6243a, Revised Statutes, or Article 6243a-1, Revised Statutes, to TMRS.
SECTION 2. Provides that Section 852.005, Government Code, as amended by this Act, applies only with respect to a person who is an employee of the pension system provided under Article 6243a-1, Revised Statutes, on or after the effective date of this Act.
SECTION 3. Effective date: September 1, 2021.
