BACKGROUND AND PURPOSE

The Health and Human Services Commission has access to certain criminal history record information, but lacks explicit authorization to access criminal history information contained in the juvenile justice information system. H.B. 4158 seeks to remedy this situation by clarifying this authority.

CRIMINAL JUSTICE IMPACT

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

ANALYSIS

H.B. 4158 amends the Family Code to clarify that confidential criminal history record information contained in the juvenile justice information system may be disseminated by the Department of Public Safety to the Health and Human Services Commission as provided by statutory provisions granting access to that information.

EFFECTIVE DATE

On passage, or, if the bill does not receive the necessary vote, September 1, 2021.
