BACKGROUND AND PURPOSE
The Texas Military Department occasionally operates in areas where identification could potentially lead to hostile actions or enemy surveillance. For that reason, the requirement for state-owned vehicles to have a certain inscription printed on each side is an issue for the department, as it could lead to department vehicles drawing unwanted attention. A number of agencies are already exempt from this requirement. S.B. 795 would extend that exemption to the Texas Military Department.

CRIMINAL JUSTICE IMPACT
It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

RULEMAKING AUTHORITY
It is the committee's opinion that rulemaking authority is expressly granted to the governing body of the Texas Military Department in SECTION 1 of this bill.

ANALYSIS
S.B. 795 amends the Transportation Code to authorize the governing body of the Texas Military Department by rule to exempt a vehicle that is under the control and custody of the department from state-owned motor vehicle inscription requirements.
