AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

S.B. 1212 reduces the number of the board of directors who govern the Booker Hospital District from seven to five members.

 

Additionally, S.B. 1212 states that two directors will be elected in odd-numbered years and three directors will be elected in even-numbered years.

 

As proposed, S.B. 1212 amends current law relating to the composition of the board of directors of the Booker Hospital District.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Section 1003.051, Special District Local Laws Code, to decrease the number of board directors that govern the Booker Hospital District (district) from seven to five.

 

SECTION 2. Amends Section 1003.052(a), Special District Local Laws Code, as follows:

 

(a) Provides that unless a four-year term is established under Section 285.081 (Terms), Health and Safety Code:

 

(1)� makes no changes to this subdivision;

 

(2) two, rather than three, directors are required to be elected in odd-numbered years and three, rather than four, directors are required to be elected in even-numbered years; and

 

(3) makes no changes to this subdivision.

 

SECTION 3. (a) Requires that five directors be elected at the election for directors of the district to be held on May 7, 2022. Requires that the three directors who receive the three highest number of total votes cast at the election serve two-year terms and the two directors who receive the fourth and fifth highest number of total votes cast at the election serve one-year terms.

 

(b) Provides that, notwithstanding Section 1003.051 (Board), Special District Local Laws Code, as amended by this Act, the seven directors serving on the board of directors immediately before the effective date of this Act continue to serve as the district's governing body until a majority of the directors elected on May 7, 2022, take office, and the former law is continued in effect for that purpose. Provides that the terms of the directors serving on the board of directors immediately before the effective date of this Act expire on the date a majority of the directors elected on May 7, 2022, take office.

 

(c) Provides that service on the board of directors of the district before May 7, 2022, does not make a person ineligible for election as a director of the district at the election held on May 7, 2022, or at a subsequent election of district directors.

 

SECTION 4. Effective date: September 1, 2021.
