A BILL TO BE ENTITLED

|
AN ACT
|
|
relating to educational requirements for certain incarcerated |
|
students. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Chapter 19, Government Code is amended by adding |
|
Section 19.013 to read as follows: |
|
Sec. 19.013 EDUCATIONALREQUIREMENTS FOR CERTAIN |
|
INCARCERATED STUDENTS. (a) The Windham School District shall |
|
provide a course of instruction that includes the required |
|
curriculum leading to a standard high school diploma for |
|
consideration to each incarcerated student who is younger than 18 |
|
years of age or younger than 22 years of age if receiving special |
|
education services. Referrals to the standard high school diploma |
|
program or the high school equivalency program will take into |
|
consideration time remaining on sentence, current educational |
|
functioning level and recommendations by the Admissions, Review and |
|
Dismissal Committee. The Texas Education Agency shall collaborate |
|
with the department in providing necessary materials for |
|
instruction. |
|
(b) The department may enter into an agreement with the |
|
Windham School District for purposes of complying with this |
|
section. |
|
(c) The board may adopt rules as necessary to implement this |
|
section. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2021. |
