A BILL TO BE ENTITLED

|
AN ACT
|
|
|
relating to best management practices for aggregate production |
|
|
operations. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. The heading to Chapter 28A, Water Code, is |
|
|
amended to read as follows: |
|
|
CHAPTER 28A. REGULATION [REGISTRATION AND INSPECTION] OF CERTAIN |
|
|
AGGREGATE PRODUCTION OPERATIONS |
|
|
SECTION 2. The heading to Subchapter B, Chapter 28A, Water |
|
|
Code, is amended to read as follows: |
|
|
SUBCHAPTER B. REGISTRATION, [AND] INSPECTION, AND BEST PRACTICES |
|
|
SECTION 3. Subchapter B, Chapter 28A, Water Code, is |
|
|
amended by adding Section 28A.055 to read as follows: |
|
|
Sec. 28A.055. BEST MANAGEMENT PRACTICES. The commission |
|
|
shall adopt and make accessible on the commission's Internet |
|
|
website best management practices for aggregate production |
|
|
operations to comply with applicable environmental laws and rules. |
|
|
SECTION 4. As soon as practicable after the effective date |
|
|
of this Act, the Texas Commission on Environmental Quality shall |
|
|
adopt the best management practices required under Section 28A.055, |
|
|
Water Code, as added by this Act. |
|
|
SECTION 5. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2021. |
