A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to property owners' association annual meetings held |
|
electronically. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 209.014(a), Property Code, is amended to |
|
read as follows: |
|
(a) Notwithstanding any provision in a dedicatory |
|
instrument, a board of a property owners' association shall call an |
|
annual meeting of the members of the association. An annual meeting |
|
may be held by any method of communication, including electronic or |
|
telephonic means as described by Section 6.002, Business |
|
Organizations Code, provided that: |
|
(1) each person in attendance at the meeting may hear |
|
and be heard by every other person at the meeting; and |
|
(2) the notice of the meeting sent to members of the |
|
association includes instructions to access any communication |
|
method required to attend the meeting remotely. |
|
SECTION 2. Section 209.00592(a-1), Property Code, is |
|
amended to read as follows: |
|
(a-1) Except as provided by this subsection, [unless a |
|
dedicatory instrument provides otherwise,] a property owners' |
|
association is not required to provide an owner with more than one |
|
voting method. An owner must be allowed to vote by one of the |
|
following voting methods: |
|
(1) absentee ballot; |
|
(2) [or] proxy; or |
|
(3) electronic ballot. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2021. |
