A BILL TO BE ENTITLED
 
AN ACT
  relating to property owners' association annual meetings held
  electronically.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 209.014(a), Property Code, is amended to
  read as follows:
         (a)  Notwithstanding any provision in a dedicatory
  instrument, a board of a property owners' association shall call an
  annual meeting of the members of the association.  An annual meeting
  may be held by any method of communication, including electronic or
  telephonic means as described by Section 6.002, Business
  Organizations Code, provided that:
               (1)  each person in attendance at the meeting may hear
  and be heard by every other person at the meeting; and
               (2)  the notice of the meeting sent to members of the
  association includes instructions to access any communication
  method required to attend the meeting remotely.
         SECTION 2.  Section 209.00592(a-1), Property Code, is
  amended to read as follows:
         (a-1)  Except as provided by this subsection, [unless a
  dedicatory instrument provides otherwise,] a property owners'
  association is not required to provide an owner with more than one
  voting method. An owner must be allowed to vote by one of the
  following voting methods:
               (1)  absentee ballot;
               (2)  [or] proxy; or
               (3)  electronic ballot.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2021.
