A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the notice requirements for permits for the commercial |
|
|
surface disposal of oil and gas wastes. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 91.116, Natural Resources Code, is |
|
|
amended by amending Subsection (b) and adding Subsection (e) to |
|
|
read as follows: |
|
|
(b) A person who files an application for a permit for a |
|
|
commercial surface disposal facility shall provide [publish] |
|
|
notice of the application in accordance with this section. |
|
|
(e) In addition to publishing notice of the permit |
|
|
application as required by Subsection (d), the applicant shall give |
|
|
notice of the permit application to a river authority or |
|
|
groundwater conservation district whose territory contains the |
|
|
tract of land on which a disposal pit will be located or on which the |
|
|
disposal will take place. |
|
|
SECTION 2. Section 91.116, Natural Resources Code, as |
|
|
amended by this Act, applies only to an application for an oil and |
|
|
gas waste disposal permit that is filed on or after the effective |
|
|
date of this Act. An application for a permit filed before the |
|
|
effective date of this Act is governed by the law in effect on the |
|
|
date of filing, and that law is continued in effect for that |
|
|
purpose. |

SECTION 3. This Act takes effect September 1, 2021. |
