A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to eligibility for a service retirement annuity of members |
|
of the elected class of the Employees Retirement System of Texas. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 814.102, Government Code, is amended to |
|
read as follows: |
|
Sec. 814.102. ELIGIBILITY OF ELECTED MEMBERS FOR SERVICE |
|
RETIREMENT. Except as provided by rule adopted under Section |
|
813.304(d) or Section 803.202(a)(2), a member who has service |
|
credit in the elected class of membership, is eligible to retire and |
|
receive a service retirement annuity if the member: |
|
(1) is at least 60 years old and has: |
|
(A) except as provided by Paragraph (B) of this |
|
subdivision, eight [8] years of service credit in that class; or |
|
(B) six years of service credit in that class, if |
|
the member: |
|
(i) has at least two years of military |
|
service; and |
|
(ii) if applicable, was released from |
|
military duty under conditions not dishonorable; or |
|
(2) is at least 50 years old and has: |
|
(A) except as provided by Paragraph (B) of this |
|
subdivision, 12 years of service credit in that class; or |
|
(B) 10 years of service credit in that class, if |
|
the member: |
|
(i) has at least two years of military |
|
service; and |
|
(ii) if applicable, was released from |
|
military duty under conditions not dishonorable. |
|
SECTION 2. This Act takes effect September 1, 2021. |
