A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the applicability of certain laws relating to |
|
|
contingent fee contracts for legal services entered into by certain |
|
|
political subdivisions. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 2254.102(e), Government Code, is amended |
|
|
to read as follows: |
|
|
(e) This subchapter does not apply to a contract for legal |
|
|
services entered into under Section 6.30, Tax Code, Article |
|
|
103.0031, Code of Criminal Procedure, Sections 11.38(b-1) and |
|
|
61.36(b-1), Alcoholic Beverage Code, or Section 1201.027 of this |
|
|
code except that Sections 2254.1032, 2254.1034, 2254.1036, and |
|
|
2254.1037 of this code do apply to the contract. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a contract entered into on or after the effective date of this |
|
|
Act. A contract entered into before the effective date of this Act |
|
|
is governed by the law in effect immediately before the effective |
|
|
date of this Act, and that law is continued in effect for that |
|
|
purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2021. |
