A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to contacting certain relatives of a child in the managing |
|
|
conservatorship of the Department of Family and Protective |
|
|
Services. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 263.007, Family Code, is amended to read |
|
|
as follows: |
|
|
Sec. 263.007. REPORT AND AFFIDAVIT REGARDING NOTIFICATION |
|
|
OF RELATIVES. (a) Not later than the 10th day before the date set |
|
|
for a hearing under Subchapter C, the department shall file with the |
|
|
court a report regarding: |
|
|
(1) the efforts the department made to identify, |
|
|
locate, and provide information to the individuals described by |
|
|
Section 262.1095; |
|
|
(2) the name of each individual the department |
|
|
identified, located, or provided with information; and |
|
|
(3) if applicable, an explanation of why the |
|
|
department was unable to identify, locate, or provide information |
|
|
to an individual described by Section 262.1095. |
|
|
(b) The report under Subsection (a) must be accompanied by |
|
|
an affidavit affirming the contents of the report. |
|
|
SECTION 2. The change in law made by this Act applies to a |
|
|
suit affecting the parent-child relationship that is filed on or |
|
|
after the effective date of this Act. A suit affecting the |
|
|
parent-child relationship filed before the effective date of this |
|
|
Act is governed by the law in effect on the date the suit was filed, |
|
|
and the former law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2021. |
