A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the date on which the election for statewide elected |
|
|
officials and members of the legislature is held. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter A, Chapter 41, Election Code, is |
|
|
amended by adding Section 41.003 to read as follows: |
|
|
Sec. 41.003. ELECTION OF EXECUTIVE OFFICERS AND MEMBERS OF |
|
|
LEGISLATURE. (a) Notwithstanding any other law, the election for |
|
|
an executive officer listed under Section 1, Article IV, Texas |
|
|
Constitution, other than the secretary of state, and for members of |
|
|
the legislature shall be held on the first Tuesday after the first |
|
|
Monday in November in odd-numbered years. |
|
|
(b) A law, rule, or provision that applies to the general |
|
|
election for state and county officers applies to an election held |
|
|
under this section. |
|
|
(c) The first election held under this section shall be held |
|
|
on November 7, 2023. A person who occupies an office pending the |
|
|
outcome of that election, either as a constitutional holdover from |
|
|
the prior term or through other law, is entitled to receive the |
|
|
emoluments of office until the successor qualifies for the office |
|
|
after the election. This subsection expires September 1, 2025. |
|
|
SECTION 2. This Act takes effect January 1, 2022. |
