A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to the generation of electricity using a wind-powered |
|
|
generation facility. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 39.351, Utilities Code, is amended by |
|
|
adding Subsection (d) to read as follows: |
|
|
(d) The commission by rule shall require a person registered |
|
|
under this section who operates a wind-powered generation facility |
|
|
to maintain the capability to generate at least 75 percent of the |
|
|
facility's nameplate capacity as a condition of maintaining the |
|
|
registration. |
|
|
SECTION 2. This Act takes effect September 1, 2021. |
