A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to vehicle modification services provided under the |
|
|
vocational rehabilitation program. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 352, Labor Code, is |
|
|
amended by adding Section 352.109 to read as follows: |
|
|
Sec. 352.109. APPORTIONED VEHICLE MODIFICATION SERVICES. |
|
|
(a) If, after a vehicle modification review is conducted, it is |
|
|
determined that a portion of an applicant's requested vehicle |
|
|
modifications is not safe, the commission shall: |
|
|
(1) inform the applicant about the unsafe |
|
|
modification; and |
|
|
(2) on the applicant's request, make a determination |
|
|
regarding whether the unsafe modification violates state or federal |
|
|
law and, if the commission determines that the unsafe modification |
|
|
does not violate applicable state or federal law: |
|
|
(A) provide those modifications that were |
|
|
determined safe; and |
|
|
(B) allow the applicant to pay out-of-pocket for |
|
|
those modifications that were determined unsafe. |
|
|
(b) The commission shall adopt rules necessary to implement |
|
|
this section. |
|
|
SECTION 2. This Act takes effect September 1, 2021. |
