A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the obstruction from public view of flaring at a natural |
|
|
gas liquefaction facility and liquefied natural gas export |
|
|
terminal. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 382.051961, Health and Safety Code, is |
|
|
amended by adding Subsection (d) to read as follows: |
|
|
(d) A permit by rule or a standard permit relating to a |
|
|
natural gas liquefaction facility and liquefied natural gas export |
|
|
terminal must require any elevated flare stack or ground flare |
|
|
located at the facility to be constructed in a manner that obscures |
|
|
from public view any flaring occurring at the facility. |
|
|
SECTION 2. Section 382.051961(d), Health and Safety Code, |
|
|
as added by this Act, applies only to a permit the application for |
|
|
which is filed with the Texas Commission on Environmental Quality |
|
|
on or after the effective date of this Act. A permit the |
|
|
application for which is filed before the effective date of this Act |
|
|
is governed by the law in effect on the date of filing, and that law |
|
|
is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2021. |
