A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to certain calculations made for load shedding in the |
|
|
ERCOT power region. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter D, Chapter 39, Utilities Code, is |
|
|
amended by adding Section 39.159 to read as follows: |
|
|
Sec. 39.159. LOAD SHED PERCENTAGE CALCULATIONS. (a) The |
|
|
commission by rule shall require each transmission and distribution |
|
|
utility, municipally owned utility, and electric cooperative in the |
|
|
ERCOT power region to submit annually to the independent |
|
|
organization certified for the ERCOT power region a determination |
|
|
of the utility's or cooperative's peak load for the summer season |
|
|
and peak load for the winter season. |
|
|
(b) The independent organization certified for the ERCOT |
|
|
power region shall make annual determinations of load shed |
|
|
percentages for use during emergency curtailment based on the peak |
|
|
load information submitted under Subsection (a). |
|
|
(c) The independent organization certified for the ERCOT |
|
|
power region may use a look-back period to determine load shed |
|
|
percentages for use during emergency curtailment if the independent |
|
|
organization does not have sufficient information submitted under |
|
|
Subsection (a) for the organization to make the determination as |
|
|
provided by Subsection (b). |

|
SECTION 2. This Act takes effect September 1, 2021. |
