A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the release of student directory information by a |
|
|
public institution of higher education. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter Z, Chapter 51, Education Code, is |
|
|
amended by adding Section 51.9716 to read as follows: |
|
|
Sec. 51.9716. CONFIDENTIALITY OF STUDENT DIRECTORY |
|
|
INFORMATION. (a) In this section, "institution of higher |
|
|
education" has the meaning assigned by Section 61.003. |
|
|
(b) Except as provided by Subsection (c) and to provide |
|
|
privacy protections in addition to those provided under the Family |
|
|
Educational Rights and Privacy Act of 1974 (20 U.S.C. Section |
|
|
1232g), an institution of higher education may not sell or release |
|
|
information the institution designates as directory information |
|
|
about a student under that federal law, including the student's |
|
|
name, e-mail address, physical address, and telephone number, |
|
|
unless the student or the student's parent, if applicable, provides |
|
|
the institution written consent. |
|
|
(c) An institution of higher education is not prohibited |
|
|
from releasing designated directory information if the institution |
|
|
releases the information under an exception provided under the |
|
|
Family Educational Rights and Privacy Act of 1974 (20 U.S.C. |
|
|
Section 1232g(b)) for the release of education records without the |
|
|
written consent of a student or a student's parent, if applicable. |
|
|
SECTION 2. This Act takes effect September 1, 2021. |
