A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the creation of an advisory committee by the Railroad |
|
|
Commission of Texas to facilitate the movement of natural gas to |
|
|
high priority customers during periods of emergency. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Amend Subchapter C, Natural Resources Code by |
|
|
adding a new Section 82.01 to read as follows: |
|
|
Sec 81.073 CREATION OF ADVISORY COMMITTEE TO FACILITATE THE |
|
|
MOVEMENT OF NATURAL GAS TO HUMAN NEEDS CUSTOMERS DURING AN |
|
|
EMERGENCY. (a) The Railroad Commission will establish an advisory |
|
|
committee to be known as the Texas Energy Reliability Council |
|
|
(TERC) to coordinate and facilitate natural gas supplies to human |
|
|
needs and other high priority needs during emergencies when the |
|
|
supply of natural gas may not be sufficient to meet the demand for |
|
|
natural gas. It may establish the TERC by either adopting a rule or |
|
|
by entering an order |
|
|
(b) The Railroad Commission will appoint the members of the |
|
|
TERC to include at least the following: |
|
|
(1) representatives of state agencies or other |
|
|
governmental entities that the Railroad Commission determines will |
|
|
be necessary or useful in accomplishing the goals of the TERC; |
|
|
(2) entities which operate facilities essential or |
|
|
useful to the natural gas supply chain; |
|
|
(3) entities which operate facilities essential or |
|
|
useful to the provision of electric power to human needs customer; |
|
|
(4) organizations or individuals with useful |
|
|
knowledge of the natural has supply chain or the provision of |
|
|
electric power to the public. |
|
|
(c) The Railroad Commission is authorized to convene the |
|
|
TERC at such time and places and in such manner as it deems |
|
|
necessary or useful in accomplishing the goals of TERC. |
|
|
(d) The Railroad Commission will appoint a Chairman from |
|
|
among the members it appoints |
|
|
(e) Chapter 2110 Government Code does not apply to the |
|
|
Commission or the TERC with regard to the creation or operation of |
|
|
TERC. |
|
|
(f) The TERC is not a governmental entity subject to |
|
|
Chapters 551 or 552 of the Government Code. |
|
|
(g) The Railroad Commission shall adopt such rules as it |
|
|
deems necessary or useful with regard to the organization and |
|
|
operation of the TERC. |
|
|
SECTION 3. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article II, Texas Constitution. If this Act |
|
|
does not receive the vote necessary for immediate effect, this Act |
|
|
takes effect September 1, 2021. |
