A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to the designation of certain premises as critical load. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Subchapter D, Chapter 38, Utilities Code, is |
|
amended by adding Section 38.074 as follows: |
|
Sec. 38.074. CRITICAL LOAD DESIGNATION. (a) The |
|
commission by rule shall establish a process for priority of |
|
designation and eligibility requirements for a transmission and |
|
distribution utility to designate a premise as critical load. The |
|
commission shall coordinate with other agencies with primary |
|
jurisdiction over entities with critical load designation |
|
premises. |
|
(b) In providing eligibility requirements under Subsection |
|
(a), the commission shall include premises for upstream natural gas |
|
production, midstream natural gas transportation, fuel production, |
|
nitrogen supply, hydrogen supply, water supply, and |
|
telecommunications. |
|
(c) The commission shall make an annual report to the |
|
legislature regarding critical load entity designation, including |
|
implementation and results, beginning no later than January 1, |
|
2022. |
|
SECTION 3. The Public Utility Commission shall adopt rules |
|
as required by Section 38.074 Utilities Code, as added by this Act, |
|
not later than September 1, 2021 if the Act takes immediate effect. |
|
The Public Utility Commission shall adopt rules as required by |
|
Section 38.074, Utilities Code, as added by this Act, not later than |
|
November 1, 2021 if the Act takes effect September 1, 2021. |
|
SECTION 4. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article II, Texas Constitution. If this Act |
|
does not receive the vote necessary for immediate effect, this Act |
|
takes effect September 1, 2021. |
