A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to a political subdivision's authority to deny or limit |
|
|
access to dying members of an individual's family. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 370, Local Government Code, is amended |
|
|
by adding Section 370.007 to read as follows: |
|
|
Sec. 370.007. AUTHORITY TO DENY OR LIMIT ACCESS TO CERTAIN |
|
|
DYING INDIVIDUALS. A political subdivision may not adopt or |
|
|
enforce an order, ordinance, or other measure, including under |
|
|
Chapter 418, Government Code, that prohibits or limits the amount |
|
|
of time of an individual's access to an imminently dying member of |
|
|
the individual's family. |
|
|
SECTION 2. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2021. |
