A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of the Public Utility Commission of Texas |
|
|
to set wholesale electricity prices in the ERCOT power region |
|
|
during a state of disaster. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 39.151, Utilities Code, is amended by |
|
|
adding Subsection (d-5) to read as follows: |
|
|
(d-5) Notwithstanding Subsection (d), during a state of |
|
|
disaster declared by the governor under Chapter 418, Government |
|
|
Code, in response to an extreme weather event, the commission may |
|
|
not by order raise the wholesale price of electric energy sold in |
|
|
the ERCOT power region for the purpose of correcting the price of |
|
|
electric energy to match the demand for electric energy. |
|
|
SECTION 2. This Act takes effect September 1, 2021. |
