A JOINT RESOLUTION
|
|
proposing a constitutional amendment requiring the state to expand |
|
eligibility for Medicaid to certain persons under the federal |
|
Patient Protection and Affordable Care Act. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Article XVI, Texas Constitution, is amended by |
|
adding Section 74 to read as follows: |
|
Sec. 74. The state shall provide medical assistance to all |
|
persons who apply for that assistance and for whom federal matching |
|
funds are available under the Patient Protection and Affordable |
|
Care Act (Pub. L. No. 111-148), as amended by the Health Care and |
|
Education Reconciliation Act of 2010 (Pub. L. No. 111-152), to the |
|
state to provide that assistance. |
|
SECTION 2. The following temporary provision is added to |
|
the Texas Constitution: |
|
TEMPORARY PROVISION. (a) This temporary provision applies |
|
to the constitutional amendment proposed by the 87th Legislature, |
|
Regular Session, 2021, requiring the state to expand eligibility |
|
for Medicaid to all persons for whom federal matching funds are |
|
available under the federal Patient Protection and Affordable Care |
|
Act. |
|
(b) Section 74, Article XVI, of this constitution takes |
|
effect January 1, 2022. |
|
(c) This temporary provision expires January 1, 2023. |
|
SECTION 3. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 2, 2021. |
|
The ballot shall be printed to provide for voting for or against the |
|
proposition: "The constitutional amendment requiring the state to |
|
expand eligibility for Medicaid to all persons for whom federal |
|
matching funds are available under the federal Patient Protection |
|
and Affordable Care Act." |
