A JOINT RESOLUTION
|
|
proposing a constitutional amendment prohibiting the state from |
|
expanding eligibility for Medicaid under the federal Patient |
|
Protection and Affordable Care Act. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 51-a, Article III, Texas Constitution, |
|
is amended by adding Subsection (b-1) to read as follows: |
|
(b-1) Notwithstanding Subsection (b) of this section, the |
|
state may not provide medical assistance to any person who became |
|
newly eligible for that assistance under the Patient Protection and |
|
Affordable Care Act (Pub. L. No. 111-148), as amended by the Health |
|
Care and Education Reconciliation Act of 2010 (Pub. L. |
|
No. 111-152), but would not be eligible for that assistance under |
|
the eligibility criteria in effect in this state on January 1, 2021. |
|
SECTION 2. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 2, 2021. |
|
The ballot shall be printed to provide for voting for or against the |
|
proposition: "The constitutional amendment prohibiting the state |
|
from expanding eligibility for Medicaid under the federal Patient |
|
Protection and Affordable Care Act." |
