A JOINT RESOLUTION
|
|
proposing a constitutional amendment to authorize the legislature |
|
to review and terminate an order issued by the governor during a |
|
state of disaster or emergency declared by the governor. |
|
BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Article III, Texas Constitution, is amended by |
|
adding Section 42 to read as follows: |
|
Sec. 42. (a) Notwithstanding Section 40 of this article, |
|
the legislature may review and terminate during a regular or |
|
special session an order issued by the governor during a state of |
|
disaster or emergency declared by the governor. The legislature may |
|
terminate the order by passage of a resolution approved by a |
|
majority vote of the members present in each house of the |
|
legislature. |
|
(b) A vote under Subsection (a) of this section is not |
|
subject to Section 15, Article IV, of this constitution. |
|
SECTION 2. This proposed constitutional amendment shall be |
|
submitted to the voters at an election to be held November 2, 2021. |
|
The ballot shall be printed to permit voting for or against the |
|
proposition: "The constitutional amendment to authorize the |
|
legislature to review and terminate an order issued by the governor |
|
during a state of disaster or emergency declared by the governor." |
