A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the payment of certain employer contributions for |
|
|
employed retirees of the Teacher Retirement System of Texas. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 825.4092, Government Code, is amended by |
|
|
adding Subsection (f) to read as follows: |
|
|
(f) A reporting employer is ultimately responsible for |
|
|
payment of the amounts required to be contributed under Subsections |
|
|
(b) and (c). The employer may not directly or indirectly pass that |
|
|
cost on to the retiree through payroll deduction, by imposition of a |
|
|
fee, or by any other means designed to recover the cost. |
|
|
SECTION 2. The changes in law made by this Act apply to a |
|
|
retiree of the Teacher Retirement System of Texas regardless of |
|
|
whether the person retired from employment before, on, or after the |
|
|
effective date of this Act. |
|
|
SECTION 3. The changes in law made by this Act apply |
|
|
beginning with the 2021-2022 school year. |
|
|
SECTION 4. This Act takes effect immediately if it receives |
|
|
a vote of two-thirds of all the members elected to each house, as |
|
|
provided by Section 39, Article III, Texas Constitution. If this |
|
|
Act does not receive the vote necessary for immediate effect, this |
|
|
Act takes effect September 1, 2021. |
