No significant fiscal implication to the State is anticipated.
The bill would amend the Business & Commerce Code to prohibit a person or legal entity making a payment under an agreement to charge a fee to the payee because the payee elects to receive the payment via paper check instead of via any form of electronic funds transfer.
Any contract provision permitting such a fee is void and unenforceable.
