No significant fiscal implication to the State is anticipated.
The bill would allow nursing facilities to file an action against a resident's responsible payor if the payor is found to have misappropriated the resident's resources to a degree that the resident is unable to pay for their care at the facility. Nursing facilities would not be allowed to recover a total amount, including damages and attorney's fees, that exceeds the amount the payor has misappropriated from the resident.
Based on information provided by the Office of Court Administration and the Health and Human Services Commission, it is assumed that duties and responsibilities associated with implementing the bill could be accomplished utilizing available resources. In addition, no significant fiscal impact to the state court system is anticipated with the implementation of the bill.
