No significant fiscal implication to the State is anticipated.
The bill would amend the Penal Code to provide that the meaning of “compulsion” for purposes of determining whether a defendant is entitled to assert duress as an affirmative defense would change from what a person of reasonable firmness would do to what a reasonable person in the situation of the defendant would do.
Based on information provided by the Office of Court Administration, no significant fiscal impact to the state court system is anticipated as a result from implementing the provisions of the bill.
