Because the number of persons or entities that may cease to request or become ineligible to request and purchase motor vehicle information as a result of the enactment of the bill is unknown, the impact to State revenue cannot be determined at this time.

The bill would amend Section 730.007 of the Transportation Code to repeal the authorization for a state agency or political subdivision to disclose personal information in connection with a motor vehicle record if the requestor represents that the use of the information is strictly limited to motor vehicle market research activities, including survey research. The bill would add Section 730.013(b-1) to prohibit a person or entity who receives personal information related to a driver's license or permit from an authorized recipient of that information from using the information for bulk distribution for surveys, marketing, or solicitations. The bill would take effect on September 1, 2021.

The Texas Department of Motor Vehicles (TxDMV) indicates that enactment of the bill could result in an unspecified number of entities ceasing to purchase or being prohibited from purchasing motor vehicle record information from the agency. Fees assessed by TxDMV for such records requests are deposited to the Texas Department of Motor Vehicles Fund.

The Department of Public Safety indicates that the implications of new Section 730.013(b-1) are unknown. However, if this provision of the bill were to result in a decrease in requests for driver record information, there would be a negative revenue impact to the Texas Mobility Fund.

Because the number of persons or entities that may cease to request or become ineligible to request and purchase motor vehicle information as a result of the enactment of the bill is unknown, the impact to State revenue cannot be determined at this time.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
