LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 87TH LEGISLATIVE REGULAR SESSION

April 22, 2021

TO:
Honorable Bryan Hughes, Chair, Senate Committee on State Affairs

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SB162 by Blanco (relating to a false statement made to illegally acquire a firearm; creating a criminal offense.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Penal Code as it relates to the unlawful transfer of certain weapons to make it a state jail felony for a person while prohibited from possessing a firearm under state or federal law to knowingly make a materially false statement on a form that is required by state or federal law for the purchase, sale, or other transfer of a firearm and that is submitted to a licensed firearms dealer.

This analysis assumes implementing the provisions of the bill addressing felony sanctions would not result in a significant impact on state correctional populations or on the demand for state correctional resources and that any costs associated with the bill's provisions could be absorbed using existing resources.

According to the Office of Court Administration, any increased case volume driven by the bill should be absorbed by existing resources and no significant fiscal impact to the state court system is anticipated.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
