SB355 by Miles (relating to the civil penalty for certain signs placed on the right-of-way of a public road.), Committee Report 2nd House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend Transportation Code ยง393.007 to change the civil penalty that may be imposed for placement of an unauthorized sign on the right-of-way of a public road from an amount not less than $500 or more than $1,000 for each violation to an amount not to exceed $1,000 for a first violation, $2,500 for a second violation, and $5,000 for a third or subsequent violation. 

Based on the information provided by the Texas Department of Transportation, the Office of Court Administration, and the Comptroller's office, it is assumed implementation of the bill would not result in a significant operational or fiscal impact to the State.

Local Government Impact

The Texas Association of Counties anticipates a fiscal impact on counties, but in an amount that cannot be determined without data on illegal signage in unincorporated areas.
