SB1261 by Birdwell (Relating to the exclusive jurisdiction of the state to regulate greenhouse gas emissions in this state and the express preemption of local regulation of those emissions.), As Engrossed

No significant fiscal implication to the State is anticipated.

The bill would amend the Health and Safety Code to clarify that the state has exclusive jurisdiction over the regulation of greenhouse gas emissions in the state to the extent that this is not preempted by federal law. 

Based on information provided by the Texas Commission on Environmental Quality, it is assumed that duties and responsibilities associated with implementing the provisions of the bill could be absorbed with existing resources.

The bill would take effect immediately upon receiving a two-thirds majority vote in both houses; otherwise, the bill would take effect September 1, 2021.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
