Pursuant to a notice posted in accordance with Senate Rule 11.10 and 11.18, a public hearing of the Senate Committee on Health & Human Services was held on Wednesday, May 5, 2021, in the Capitol Extension, Room E1.012, at Austin, Texas.

The chair called the meeting to order at 8:07 AM. There being a quorum present, the following business was transacted:

The chair laid out as a matter of pending business SB 183.

 

Senator Perry then moved that the committee substitute be adopted; without objection, it was so ordered. Senator Perry moved that SB 183 do not pass but that CSSB 183 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent. Senator Perry moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered. 

 

The chair laid out as a matter of pending business SB 1059.

 

Senator Perry then moved that the committee substitute be adopted; without objection, it was so ordered. Senator Perry moved that SB 1059 do not pass but that CSSB 1059 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent.

 

The chair laid out as a matter of pending business SB 1386.

 

Senator Perry then moved that the committee substitute be adopted; without objection, it was so ordered. Senator Perry moved that SB 1386 do not pass but that CSSB 1386 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent.

 

Senator Perry assumed the chair.

 

The chair laid out as a matter of pending business SB 970.

 

Senator Campbell moved that SB 970 be reported favorably to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 9 ayes, 0 nays, 0 present not voting, and 0 absent. Senator Hall moved that the bill be recommended for placement on the Local & Uncontested Calendar; without objection, it was so ordered.

 

The chair laid out as a matter of pending business SB 962.

 

Senator Seliger sent up a committee substitute.  The chair recognized Senator Kolkhorst to explain the difference between the committee substitute and the senate bill as filed. Senator Campbell then moved that the committee substitute be adopted; without objection, it was so ordered. Senator Hall moved that SB 962 do not pass but that CSSB 962 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 7 ayes, 2 nays, 0 present not voting, and 0 absent.

 

Senator Kolkhorst resumed the chair.

 

The chair laid out as a matter of pending business SB 1914.

 

Senator Perry then moved that the committee substitute be adopted; without objection, it was so ordered. Senator Perry moved that SB 1914 do not pass but that CSSB 1914 be reported back to the Senate with the recommendation that it do pass and be printed. The motion carried with a record vote of 8 ayes, 0 nays, 1 present not voting, and 0 absent.

 

The chair laid out HB 1011 and recognized the Senate sponsor, Senator Zaffirini, to explain the bill.

 

The Chair called the following invited witnesses to provide testimony on HB 1011.(See attached witness list). Senator Kolkhorst moved that HB 1011 be left pending; without objection, it was so ordered.

 

The chair laid out HB 1792 and recognized the Senate sponsor, Senator Zaffirini, to explain the bill.

The chair laid out SB 1084 and recognized the author, Senator Powell, to explain the bill.

 

The Chair called the following invited witnesses to provide testimony on SB 1084.(See attached witness list). Senator Kolkhorst moved that SB 1084 be left pending; without objection, it was so ordered.

 

The chair laid out SB 2037 and recognized Senator Blanco, in the absence of the author, to explain the bill.

 

Senator Kolkhorst moved that SB 2037 be left pending; without objection, it was so ordered.

 

The chair laid out HB 135 and recognized the Senate sponsor, Senator Miles, to explain the bill.

 

Senator Perry sent up a committee substitute.  The chair recognized Senator Miles to explain the difference between the committee substitute and the house bill as engrossed. The Chair called the following invited witnesses to provide testimony on HB 135.(See attached witness list). Senator Kolkhorst moved that HB 135 be left pending; without objection, it was so ordered.

 

As a matter of pending business, the Chair laid out the following bills, HB 1011, HB 1792, SB 1084, SB 2037, HB 135, HB 1616. Public testimony was heard.

 

Witnesses testifying and registering on the bills are shown on the attached list.

 

These bills were left pending.

 

There being no further business, Senator Perry moved that the Committee stand recessed subject to the call of the chair. Without objection, it was so ordered.
