AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

The Texas Legislature enacted legislation in 2013 providing for state grants to entities to establish or expand community collaboratives that bring the public and private sectors together to provide services to persons experiencing homelessness, substance abuse issues, or mental illness. However, there is a need for a special fund in the treasury to administer the grant program that consists of legislative appropriations, dedicated revenue, applicable interest, and any other money from gifts, grants, or donations. H.B. 3466 seeks to create the community collaboratives fund as a special account within the state treasury to dedicate funding exclusively for the purpose of the community collaboratives grant program. Additionally, the bill establishes a reporting requirement, ensuring the legislature receives timely and consistent information on participating entities, the number of persons served by community collaboratives, and the performance of community collaboratives based on established metrics.

 

H.B. 3466 amends current law relating to the administration of a grant program for the establishment and expansion of community collaboratives.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1.  Amends Chapter 539, Government Code, by adding Sections 539.010 and 539.011, as follows:

 

Sec. 539.010.� COMMUNITY COLLABORATIVES FUND.� (a)� Defines "fund."

 

(b)� Provides that the community collaboratives fund (fund) is established as a special fund in the state treasury.

 

(c)� Provides that the fund consists of:

 

(1)� legislative appropriations to the Department of State Health Services (DSHS) for a purpose of the fund;

 

(2)� any revenue that by law is dedicated for deposit to the fund;

 

(3)� interest or other earnings on money credited to or allocable to the fund; and

 

(4)� money from gifts, grants, or donations to the fund.

 

(d)� Authorizes DSHS to use the fund only to:

 

(1)� provide grants to entities in accordance with Chapter 539 (Community Collaboratives); and

 

(2)� pay the necessary and reasonable expenses of administering the fund.

 

Sec. 539.011.� BIENNIAL REPORT.� (a)� Requires DSHS to prepare a report that includes:

 

(1)� the method by which DSHS chose entities to award grants to under this chapter;

 

(2)� the amount of each grant awarded to an entity under this chapter;

 

(3)� the number of individuals served by each community collaborative receiving grant funds under this chapter; and

 

(4)� the results of the annual review of outcome measures required by Section 539.006 (Annual Review of Outcome Measures).

 

(b)� Requires DSHS, not later than September 1 of each even-numbered year, �to submit a report described by Subsection (a) to:

 

(1)� the standing committees of the legislature having jurisdiction over DSHS and state finance; and

 

(2)� the Legislative Budget Board.

 

SECTION 2. Effective date: September 1, 2023.
