BACKGROUND AND PURPOSE

 

The 87th Legislature, Regular Session, enacted H.B. 2237, which made a number of changes to Chapter 53 of the Property Code. As is often the case, some small corrections in provisions relating to certain deadlines and other timing factors affecting mechanic's, contractor's, or materialman's liens were missed. C.S.H.B. 4301 seeks to make those corrections.

 

CRIMINAL JUSTICE IMPACT

 

It is the committee's opinion that this bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.

 

RULEMAKING AUTHORITY

 

It is the committee's opinion that this bill does not expressly grant any additional rulemaking authority to a state officer, department, agency, or institution.

 

ANALYSIS

 

C.S.H.B. 4301 amends the Property Code to clarify that the extension of a period for providing a notice or taking a required action regarding mechanic's, contractor's, and materialman's liens to include the next day that is not a Saturday, Sunday, or legal holiday when the last day of the period falls on such a day also applies to a deadline for providing such a notice or taking such an action that is a Saturday, Sunday, or legal holiday.

 

EFFECTIVE DATE

 

On passage, or, if the bill does not receive the necessary vote, September 1, 2023.

C.S.H.B. 4301 differs from the introduced in minor or nonsubstantive ways by conforming to certain bill drafting conventions.
