AUTHOR'S / SPONSOR'S STATEMENT OF INTENT

 

As of 2021, the total number of alternatively fueled vehicles registered in Texas is over 80,000. As more of these vehicles drive on Texas roads, there are concerns about access to charging stations that are compatible with every type of electric vehicle.

 

S.B. 1732 addresses new alternatively fueled vehicle charging station standards to ensure that Texas drivers can use the network of charging stations across the state no matter what car you drive.

 

As proposed, S.B. 1732 amends current law relating to standards for certain electric vehicle charging stations.

 

RULEMAKING AUTHORITY

 

This bill does not expressly grant any additional rulemaking authority to a state officer, institution, or agency.

 

SECTION BY SECTION ANALYSIS

 

SECTION 1. Amends Subtitle A, Title 14, Occupations Code, by adding Chapter 2311, as follows:

 

CHAPTER 2311. ELECTRIC VEHICLE CHARGING STATIONS

 

Sec. 2311.001. ELECTRIC VEHICLE CHARGING STATION STANDARDS. (a) Provides that this section applies only to an electric vehicle charging station in this state that is made available to the public and not intended primarily for private use.

 

(b) Requires the Texas Department of Licensing and Regulation (TDLR), in consultation with the Texas Department of Transportation, to adopt standards for electric vehicle charging stations that require the charging stations to be equipped with a standard electric vehicle charging connector or plug type that is widely compatible with as many electric vehicles as practicable.

 

SECTION 2. (a) Requires TDLR, as soon as practicable after the effective date of this Act, to adopt the standards required by Section 2311.001, Occupations Code, as added by this Act.

 

(b) Provides that an electric vehicle charging station to which Section 2311.001, Occupations Code, as added by this Act, applies is not required to comply with the standards adopted under that section until September 1, 2025.

 

SECTION 3. Effective date: upon passage or September 1, 2023.
