A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to immunity from civil and criminal liability for certain |
|
|
Department of Family and Protective Services contractors who |
|
|
participate in a child abuse or neglect investigation. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 261.106(b), Family Code, is amended to |
|
|
read as follows: |
|
|
(b) Immunity from civil and criminal liability extends to an |
|
|
authorized volunteer or contractor of the department or a law |
|
|
enforcement officer who participates at the request of the |
|
|
department in an investigation of alleged or suspected abuse or |
|
|
neglect or in an action arising from an investigation if the person |
|
|
was acting in good faith and in the scope of the person's |
|
|
responsibilities. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
