A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to a statewide standing order prescribing opioid |
|
antagonists. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 483.102, Health and Safety Code, is |
|
amended by adding Subsections (a-1) and (d) to read as follows: |
|
(a-1) The commissioner of state health services or, if the |
|
commissioner is not a physician, the chief medical executive of the |
|
Department of State Health Services shall issue a statewide |
|
standing order prescribing an opioid antagonist to a person |
|
described by Subsection (a)(1) or (2). |
|
(d) The commissioner or the chief medical executive who |
|
prescribes an opioid antagonist under a standing order as required |
|
under Subsection (a-1) has official immunity and may not be subject |
|
to any criminal or civil liability for: |
|
(1) issuing the standing order prescribing the opioid |
|
antagonist; or |
|
(2) any outcome resulting from the eventual |
|
administration of the opioid antagonist. |
|
SECTION 2. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2023. |
