A BILL TO BE ENTITLED

AN ACT
|
|
|
relating to procurement procedures for certain municipal housing |
|
|
authorities. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter D, Chapter 392, Local Government |
|
|
Code, is amended by adding Section 392.0566 to read as follows: |
|
|
Sec. 392.0566. PROCUREMENT PROCEDURES FOR CERTAIN |
|
|
MUNICIPAL HOUSING AUTHORITIES. Notwithstanding any other law, a |
|
|
municipal housing authority described by Section 392.0162 is |
|
|
required to comply with competitive procurement procedures |
|
|
applicable to municipal housing authorities only when making a |
|
|
purchase requiring the expenditure of an amount that is more than |
|
|
the simplified acquisition threshold as defined by the Federal |
|
|
Acquisition Regulation (48 C.F.R. Section 2.101) or a successor |
|
|
regulation. |
|
|
SECTION 2. The change in law made by this Act applies only |
|
|
to a purchase made on or after the effective date of this Act. A |
|
|
purchase made before the effective date of this Act is governed by |
|
|
the law as it existed immediately before the effective date of this |
|
|
Act, and that law is continued in effect for that purpose. |
|
|
SECTION 3. This Act takes effect September 1, 2023. |
