A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to authorizing the payment to employees of the Texas |
|
|
Department of Criminal Justice for vacation leave. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Chapter 493, Government Code, is amended by |
|
|
adding Section 493.035 to read as follows: |
|
|
Sec. 493.035. PAYMENT FOR VACATION LEAVE. (a) An employee |
|
|
of the department may, one time during a fiscal year, elect to |
|
|
receive a lump-sum payment for the employee's accumulated vacation |
|
|
leave in lieu of taking the leave. |
|
|
(b) The number of hours of accumulated vacation leave for |
|
|
which an employee may be paid under this section may not exceed all |
|
|
of the employee's accumulated vacation leave or 40 hours of |
|
|
accumulated vacation leave, whichever is less. |
|
|
(c) On receiving payment under this section, the number of |
|
|
hours for which the employee received payment are deducted from the |
|
|
employee's accumulated vacation leave balance. |
|
|
(d) Payment to an employee under this section shall be |
|
|
computed by multiplying the employee's hourly rate of compensation |
|
|
on the date the employee notifies the department of an election |
|
|
under this section by the number of hours of accumulated vacation |
|
|
leave for which the employee elects to be paid. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
