A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of the Texas Commission on Environmental |
|
|
Quality to issue an order to create a special district. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter B, Chapter 36, Water Code, is amended |
|
|
by adding Section 36.022 to read as follows: |
|
|
Sec. 36.022. COMMISSION MAY NOT CREATE DISTRICT. |
|
|
Notwithstanding any other law, the commission may not issue an |
|
|
order creating a district after September 1, 2023. |
|
|
SECTION 2. Subchapter B, Chapter 49, Water Code, is amended |
|
|
by adding Section 49.012 to read as follows: |
|
|
Sec. 49.012. COMMISSION MAY NOT CREATE DISTRICT. |
|
|
Notwithstanding any other law, the commission may not issue an |
|
|
order creating a district after September 1, 2023. |
|
|
SECTION 3. Subchapter B, Chapter 375, Local Government |
|
|
Code, is amended by adding Section 375.027 to read as follows: |
|
|
Sec. 375.027. COMMISSION MAY NOT CREATE DISTRICT. |
|
|
Notwithstanding any other law, the commission may not issue an |
|
|
order creating a district after September 1, 2023. |
|
|
SECTION 4. The changes in law made by this Act do not apply |
|
|
to the creation of a district for which the required documentation |
|
|
or petition was submitted to the Texas Commission on Environmental |
|
|
Quality before the effective date of this Act. The creation of a |
|
|
district for which the required documentation or petition was |
|
|
submitted to the Texas Commission on Environmental Quality before |
|
|
the effective date of this Act is governed by the law in effect on |
|
|
the date the district submitted the documentation or petition, and |
|
|
the former law is continued in effect for that purpose. |
|
|
SECTION 5. This Act takes effect September 1, 2023. |
