A BILL TO BE ENTITLED
|
|
AN ACT
|
|
relating to voting by a voter unable to enter a polling place. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 64.009(a), Election Code, is amended to |
|
read as follows: |
|
(a) On [If a voter is physically unable to enter the polling |
|
place without personal assistance or likelihood of injuring the |
|
voter's health, on] the voter's request, an election officer shall |
|
deliver a ballot to the voter at the polling place entrance or curb |
|
if the voter: |
|
(1) is physically unable to enter the polling place |
|
without personal assistance or likelihood of injuring the voter's |
|
health; |
|
(2) has legal custody of a child younger than 12 years |
|
of age and entering the polling place would require leaving the |
|
child without adequate supervision; or |
|
(3) is the primary caretaker of a person who is unable |
|
to care for themselves and entering the polling place would require |
|
leaving the person without adequate supervision. |
|
SECTION 2. This Act takes effect September 1, 2023. |
