A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to creating a criminal offense for the unlawful sale or |
|
|
transfer of a single-use e-cigarette product. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter H, Chapter 161, Health and Safety |
|
|
Code, is amended by adding Section 161.0876 to read as follows: |
|
|
Sec. 161.0876. UNLAWFUL SALE OR TRANSFER OF SINGLE-USE |
|
|
E-CIGARETTE PRODUCTS. (a) In this section, "single-use |
|
|
e-cigarette product" means an e-cigarette that is: |
|
|
(1) prefilled with a consumable liquid solution or |
|
|
other material aerosolized or vaporized during use of the |
|
|
e-cigarette; and |
|
|
(2) designed to be discarded after the liquid solution |
|
|
or other material is depleted. |
|
|
(b) A person commits an offense if the person sells, gives, |
|
|
delivers, or furnishes a single-use e-cigarette product to another |
|
|
person. |
|
|
(c) An offense under this section is a Class B misdemeanor. |
|
|
SECTION 2. This Act takes effect September 1, 2023. |
