A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to Medicaid coverage and reimbursement for the provision |
|
|
of certain digital therapeutics. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 32.024, Human Resources Code, is amended |
|
|
by adding Subsection (hh) to read as follows: |
|
|
(hh) The commission shall provide medical assistance |
|
|
reimbursement to a provider who participates in the vendor drug |
|
|
program or is enrolled as a network pharmacy provider in the |
|
|
provider network of a managed care organization that contracts with |
|
|
the commission under Chapter 533, Government Code, for a |
|
|
prescription digital therapeutic, as defined by commission rule, |
|
|
that is approved for use by the United States Food and Drug |
|
|
Administration. For purposes of this subsection, a digital |
|
|
therapeutic is not considered durable medical equipment. |
|
|
SECTION 2. If before implementing any provision of this Act |
|
|
a state agency determines that a waiver or authorization from a |
|
|
federal agency is necessary for implementation of that provision, |
|
|
the agency affected by the provision shall request the waiver or |
|
|
authorization and may delay implementing that provision until the |
|
|
waiver or authorization is granted. |
|
|
SECTION 3. This Act takes effect September 1, 2023. |
