A BILL TO BE ENTITLED
|
|
AN ACT
|
|
|
relating to employment activities of certain peace officers |
|
responding to an emergency call for purposes of the Texas Workers' |
|
Compensation Act. |
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
SECTION 1. Section 401.026, Labor Code, is amended to read |
|
as follows: |
|
Sec. 401.026. APPLICABILITY TO CERTAIN EMERGENCY RESPONSE |
|
PERSONNEL. For purposes of this subtitle, the travel of a |
|
firefighter, peace officer, or emergency medical personnel en route |
|
to an emergency call is considered to be in the course and scope of |
|
the firefighter's, peace officer's, or emergency medical |
|
personnel's employment. |
|
SECTION 2. The change in law made by this Act applies only |
|
to a claim for workers' compensation benefits based on a |
|
compensable injury that occurs on or after the effective date of |
|
this Act. A claim based on a compensable injury that occurs before |
|
that date is governed by the law as it existed on the date the |
|
compensable injury occurred, and the former law is continued in |
|
effect for that purpose. |
|
SECTION 3. This Act takes effect immediately if it receives |
|
a vote of two-thirds of all the members elected to each house, as |
|
provided by Section 39, Article III, Texas Constitution. If this |
|
Act does not receive the vote necessary for immediate effect, this |
|
Act takes effect September 1, 2023. |
