A BILL TO BE ENTITLED
 
AN ACT
 
  relating to employment activities of certain peace officers
  responding to an emergency call for purposes of the Texas Workers'
  Compensation Act.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 401.026, Labor Code, is amended to read
  as follows:
         Sec. 401.026.  APPLICABILITY TO CERTAIN EMERGENCY RESPONSE
  PERSONNEL.  For purposes of this subtitle, the travel of a
  firefighter, peace officer, or emergency medical personnel en route
  to an emergency call is considered to be in the course and scope of
  the firefighter's, peace officer's, or emergency medical
  personnel's employment.
         SECTION 2.  The change in law made by this Act applies only
  to a claim for workers' compensation benefits based on a
  compensable injury that occurs on or after the effective date of
  this Act. A claim based on a compensable injury that occurs before
  that date is governed by the law as it existed on the date the
  compensable injury occurred, and the former law is continued in
  effect for that purpose.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
